1. Platform Status
Sky Charter India acts solely as an aviation marketplace, booking facilitator, and lead generation platform. Sky Charter India does not own, lease, manage, maintain, operate, dispatch, control, insure, or provide any aircraft. All aviation services are performed solely by independent third-party DGCA-approved charter operators. Operational responsibility for flight execution, safety, compliance, crew, permits, maintenance, and airworthiness remains exclusively with the respective operator.
Sky Charter India is not an airline, air carrier, aircraft operator, aviation contractor, tour operator, transportation provider, aviation service provider, or travel company. The platform's sole function is to connect customers with independent operators and facilitate the booking process.
2. Definitions
- "Platform" means the Sky Charter India website, mobile application, and all related services.
- "Customer" means any individual or entity seeking to book aviation services through the Platform.
- "Operator" means an independent DGCA-approved charter operator listed on the Platform.
- "Booking" means a confirmed reservation for aviation services arranged through the Platform.
- "Services" means all aviation charter services, including but not limited to private jet charter, helicopter charter, air ambulance, wedding aviation, and aerial work.
3. Use of Services
By accessing or using the Platform, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use the Platform. Sky Charter India reserves the right to modify these terms at any time, and such modifications shall be effective immediately upon posting on the Platform.
Customers must be at least 18 years of age and have the legal capacity to enter into binding contracts. All information provided by customers must be accurate, complete, and up-to-date.
4. Operator Responsibility
The operator remains solely responsible for:
- Aircraft availability and airworthiness
- Flight operations and execution
- Aircraft maintenance and DGCA compliance
- Crew licensing, training, and passenger safety
- Insurance coverage for aircraft, crew, and passengers
- All flight permits, landing permits, and airport permissions
- Regulatory approvals and compliance with all applicable laws
- Flight delays, cancellations, substitutions, and technical defects
- Refund obligations and customer compensation
5. Booking Process
All bookings made through the Platform are subject to operator confirmation. A booking request does not constitute a confirmed booking until the operator has accepted the request and all required documentation and payments have been completed.
Sky Charter India may assist in coordinating communications between the customer and the operator, but all operational decisions, including aircraft assignment, crew selection, routing, scheduling, and pricing, remain exclusively with the operator.
6. Payment Terms
Where a customer pays directly to an operator, such payment constitutes a direct commercial transaction between the customer and the operator. Sky Charter India is not a party to such transaction and has no liability for refunds, compensation, or chargebacks.
Where payment is collected through Sky Charter India, it acts solely as a collection and facilitation agent. Collection of payment does not create liability for flight execution, which remains solely the operator's responsibility.
7. Cancellation & Refund
Cancellation and refund policies are determined by the individual operator and shall be communicated to the customer at the time of booking. Sky Charter India shall not be liable for any refunds or compensation arising from operator cancellations.
In the event of an operator cancellation, the operator remains solely responsible for all refund obligations and customer compensation. Sky Charter India may assist with communication and coordination but assumes no financial liability.
8. Limitation of Liability
Sky Charter India's aggregate liability shall not exceed INR 10,000 (Rupees Ten Thousand only). Sky Charter India shall not be liable for:
- Operator cancellation, refusal, or default
- Aircraft unavailability or technical failures
- Crew issues, weather delays, or airport closures
- Airspace restrictions, regulatory restrictions, or DGCA actions
- Government actions, security restrictions, or force majeure events
- Missed meetings, business interruption, or consequential losses
- Loss of profits, indirect, consequential, special, or punitive damages
9. Indemnity
The Operator shall defend, indemnify, and hold harmless Sky Charter India, its directors, officers, employees, and agents from and against all claims, demands, legal proceedings, regulatory actions, damages, losses, liabilities, penalties, costs, and legal fees arising from or related to: (a) the Operator's services, operations, or failures; (b) any customer complaint or dispute related to flight execution; (c) Operator's breach of contract or applicable law; (d) Operator cancellations, delays, or defaults.
10. Force Majeure
Neither Sky Charter India nor the operator shall be liable for any failure or delay in performing obligations under these terms where such failure or delay results from force majeure events, including but not limited to: floods, earthquakes, storms, natural disasters, pandemics, epidemics, government restrictions, airspace closures, airport shutdowns, political unrest, terrorism, security threats, military actions, and civil disturbances.
11. Dispute Resolution
Any dispute arising out of or in connection with these Terms & Conditions shall be resolved by a sole arbitrator mutually appointed by the parties, by ad-hoc arbitration with the seat at Jodhpur, Rajasthan, in accordance with the Arbitration and Conciliation Act, 1996 as amended. The arbitration proceedings shall be conducted in English.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the Laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and applicable DGCA regulations. The courts at Jodhpur, Rajasthan shall have exclusive jurisdiction over any disputes not subject to arbitration.
13. Amendments
Sky Charter India reserves the right to amend these Terms & Conditions at any time without prior notice. Continued use of the Platform following any amendment constitutes acceptance of the revised terms. Users are encouraged to review these terms periodically.
14. No Agency Relationship
Nothing contained in these Terms & Conditions shall be construed as creating any partnership, joint venture, employment relationship, agency relationship, franchise relationship, fiduciary relationship, or representative relationship between Sky Charter India and any Operator.
Each Operator is an independent third-party service provider and is not an employee, representative, partner, agent, affiliate, or authorized signatory of Sky Charter India.
15. No Guarantee of Operator Performance
Sky Charter India does not guarantee the availability, performance, conduct, financial stability, operational capability, safety record, service quality, or solvency of any Operator listed on the Platform.
Customers acknowledge that all charter services are ultimately dependent upon the independent Operator's ability and willingness to perform the requested services.
16. Operator Default, Non-Performance or Insolvency
In the event that an Operator becomes insolvent, ceases operations, refuses to perform a confirmed booking, fails to provide the contracted services, misappropriates customer funds, or otherwise defaults on its obligations, the Operator shall remain solely responsible for all refunds, compensation, liabilities, and customer claims.
Sky Charter India may provide reasonable assistance in facilitating communication between the Customer and the Operator but shall not be financially liable for any losses, damages, refunds, or compensation arising from such Operator default.
