Legal Framework

Customer Booking Agreement

Effective Date: 9 July 2026

1. Parties to the Agreement

This Customer Booking Agreement ("Agreement") is entered into between:

Sky Charter India ("Platform", "We", "Us"), a marketplace and booking facilitation platform operating under the brand name "Sky Charter India" from India; and

The Customer ("You", "Your"), the individual or entity requesting aviation charter services through the Platform.

2. Role of Sky Charter India

Sky Charter India acts solely as an aviation marketplace, booking facilitator, and lead generation platform. Sky Charter India does not own, lease, manage, maintain, operate, dispatch, control, insure, or provide any aircraft. All aviation services are performed solely by independent third-party DGCA-approved charter operators.

Sky Charter India is not an airline, air carrier, aircraft operator, aviation contractor, tour operator, transportation provider, aviation service provider, or travel company. The Platform's sole function is to connect customers with independent operators and facilitate the booking process.

3. Operator Obligations

The operator remains solely responsible for:

  • Aircraft availability, maintenance, and airworthiness compliance
  • Flight operations, execution, and safety
  • DGCA compliance, crew licensing, and crew training
  • Passenger safety and insurance coverage
  • All flight permits, landing permits, and airport permissions
  • Regulatory approvals and compliance with all applicable laws
  • Flight delays, cancellations, substitutions, and technical defects
  • Refund obligations and customer compensation

4. Customer Obligations

By making a booking through the Platform, the Customer agrees to:

  • Provide accurate, complete, and up-to-date information
  • Comply with all applicable aviation security requirements
  • Arrive at the designated airport or helipad at the specified time
  • Present valid identification and travel documents
  • Adhere to baggage and weight restrictions specified by the operator
  • Not carry prohibited items as per DGCA and airport security regulations
  • Accept that flight execution depends on operator approval and operational feasibility

5. Booking Confirmation

A booking request submitted through the Platform does not constitute a confirmed booking until the operator has accepted the request and all required documentation and payments have been completed. Sky Charter India shall communicate the operator's acceptance or rejection to the Customer in a timely manner.

The Customer acknowledges that final flight execution depends on operator approval, aircraft availability, weather conditions, technical feasibility, airport permissions, government approvals, and security requirements. Sky Charter India cannot guarantee operator performance, aircraft availability, or flight completion.

6. Payment Terms

Direct Payment to Operator: Where the Customer pays directly to the operator, such payment constitutes a direct commercial transaction between the Customer and the operator. Sky Charter India is not a party to such transaction and has no liability for refunds, compensation, or chargebacks.

Payment Through Sky Charter India: Where payment is collected through Sky Charter India, it acts solely as a collection and facilitation agent. Collection of payment does not create liability for flight execution, which remains solely the operator's responsibility.

7. Cancellation & Changes

Cancellation and change policies are determined by the individual operator and shall be communicated to the Customer at the time of booking. The Customer agrees to abide by the operator's cancellation and change policies.

In the event of an operator cancellation, the operator remains solely responsible for all refund obligations and customer compensation. Sky Charter India may assist with communication and coordination but assumes no financial liability for operator defaults.

8. Liability & Disclaimers

To the maximum extent permitted by applicable law, Sky Charter India's total aggregate liability arising out of or relating to the use of the Platform shall not exceed the amount of service fees actually received by Sky Charter India in connection with the relevant booking, or INR 10,000, whichever is lower. Sky Charter India shall not be liable for:

  • Operator cancellation, refusal, or default
  • Aircraft unavailability or technical failures
  • Crew issues, weather delays, or airport closures
  • Airspace restrictions, regulatory restrictions, or DGCA actions
  • Government actions, security restrictions, or force majeure events
  • Missed meetings, business interruption, hotel losses, or ground transportation losses
  • Loss of profits, consequential damages, indirect damages, special damages, or punitive damages

9. Indemnity

The Customer agrees to indemnify and hold harmless Sky Charter India, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and legal fees arising from the Customer's breach of this Agreement, violation of applicable laws, or misuse of the Platform.

10. Dispute Resolution

Any dispute arising out of or in connection with this Agreement shall be resolved by a sole arbitrator mutually appointed by the parties, by ad-hoc arbitration with the seat at Jodhpur, Rajasthan, in accordance with the Arbitration and Conciliation Act, 1996 as amended. The arbitration proceedings shall be conducted in English. The courts at Jodhpur, Rajasthan shall have exclusive jurisdiction over any disputes not subject to arbitration.

11. General Provisions

This Agreement constitutes the entire agreement between the Customer and Sky Charter India regarding the subject matter hereof and supersedes all prior agreements, understandings, and representations.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

This Agreement shall be governed by and construed in accordance with the Laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and applicable DGCA regulations.
