Force Majeure Policy

Effective Date: 9 July 2026

1. Definition

"Force Majeure" means any event or circumstance beyond the reasonable control of Sky Charter India or the operator, which prevents, hinders, or delays the performance of obligations under these terms. Force Majeure events include, but are not limited to, the events listed in Section 2 below.

2. Force Majeure Events

Force Majeure events include, without limitation:

  • Natural disasters: floods, earthquakes, tsunamis, hurricanes, cyclones, storms, droughts, landslides
  • Public health emergencies: pandemics, epidemics, plagues, quarantine restrictions
  • Government actions: restrictions, prohibitions, sanctions, embargoes, expropriation, nationalization
  • Aviation-specific events: airspace closures, airport shutdowns, runway closures, NOTAMs
  • Security events: terrorism, sabotage, hijacking, bomb threats, civil disturbances, riots
  • Military actions: war, invasion, armed conflict, hostilities, acts of foreign enemies
  • Technical failures: air traffic control system failures, navigation aid outages, communication breakdowns
  • Other events: strikes, lockouts, labor disputes, fire, explosion, nuclear incidents

3. Effect on Obligations

In the event of Force Majeure:

  • The affected party's obligations under these terms shall be suspended for the duration of the Force Majeure event
  • Neither Sky Charter India nor the operator shall be liable for any failure or delay in performance caused by Force Majeure
  • Booking confirmations may be postponed, modified, or cancelled as necessary
  • Refunds and compensation shall be determined by the operator's policy and applicable law

4. Notice Requirements

The party affected by Force Majeure shall notify the other party as soon as reasonably practicable, providing details of the event, its expected duration, and the obligations affected. Failure to provide timely notice may limit the affected party's ability to claim Force Majeure relief.

5. Mitigation Obligations

The affected party shall use all reasonable endeavors to mitigate the effects of the Force Majeure event, including exploring alternative arrangements, communicating with customers, and minimizing losses. The obligation to mitigate does not require the affected party to settle strikes, labor disputes, or other controversies on terms it deems unreasonable.

6. Termination Due to Force Majeure

If a Force Majeure event continues for more than thirty (30) days, either party may terminate the affected booking or agreement by providing written notice to the other party. In such cases, the operator's refund policy shall apply, and Sky Charter India shall have no liability for refunds or compensation.

7. No Liability for Force Majeure

Sky Charter India shall not be liable for any losses, damages, costs, or expenses arising from or related to Force Majeure events, including but not limited to: missed flights, missed connections, missed meetings or events, hotel losses, ground transportation losses, business interruption, loss of profits, or any consequential or indirect damages.
