Liability Disclaimer

Sky Charter India acts solely as an aviation marketplace, booking facilitator, and lead generation platform. Sky Charter India does not own, lease, manage, maintain, operate, dispatch, control, insure, or provide any aircraft. All aviation services are performed solely by independent third-party DGCA-approved charter operators. Operational responsibility for flight execution, safety, compliance, crew, permits, maintenance, and airworthiness remains exclusively with the respective operator.

Sky Charter India shall not be liable for any act, omission, default, negligence, or misconduct of any operator, including but not limited to:

• Operator cancellation or refusal to perform services
• Aircraft unavailability or technical failures
• Crew issues, including licensing or training deficiencies
• Flight delays, diversions, or cancellations
• Accidents, incidents, or safety violations
• Regulatory violations or DGCA enforcement actions
• Operator's failure to obtain required permits or approvals
• Operator's breach of contract with the customer

The Customer acknowledges that aviation charter services are subject to inherent operational risks, including but not limited to:

• Weather conditions and meteorological restrictions
• Airport closures, runway unavailability, or airspace restrictions
• Government restrictions, security alerts, or regulatory changes
• Technical defects, maintenance requirements, or aircraft substitutions
• Crew availability and duty time limitations
• Permit delays or denial of overflight/landing permissions

Sky Charter India shall not be liable for any losses, damages, or inconveniences arising from such operational risks.

To the maximum extent permitted by applicable law, Sky Charter India's total aggregate liability arising out of or relating to the use of the Platform shall not exceed the amount of service fees actually received by Sky Charter India in connection with the relevant booking, or INR 10,000, whichever is lower.

Nothing contained in this Agreement shall be construed to create any partnership, joint venture, employment relationship, agency relationship, franchise relationship, or fiduciary relationship between Sky Charter India and any operator. Operators act as independent third-party service providers and are not representatives, agents, employees, or affiliates of Sky Charter India.

Sky Charter India does not guarantee the performance, conduct, financial capability, operational capability, solvency, availability, safety record, or service quality of any operator listed on or introduced through the Platform. Customers acknowledge that all charter services are ultimately dependent upon the independent operator's ability and willingness to perform the requested flight.

In the event an operator becomes insolvent, ceases operations, fails to perform a confirmed charter, refuses to provide services, misappropriates customer funds, or otherwise defaults on its obligations, the operator shall remain solely responsible for all refunds, compensation, liabilities, and customer claims.

Sky Charter India may provide reasonable assistance in facilitating communication between the customer and the operator but shall not be financially liable for any losses arising from such operator default.

Under no circumstances shall Sky Charter India be liable for:

• Indirect, consequential, incidental, special, or punitive damages
• Loss of profits, revenue, business, or anticipated savings
• Business interruption or loss of business opportunity
• Loss of goodwill or reputation
• Personal injury or death (liability rests with the operator)
• Damage to or loss of baggage or personal property
• Missed connections, meetings, events, or appointments
• Hotel, ground transportation, or other travel-related losses
• Any losses arising from operator actions or failures

The Platform may contain links to third-party websites or services. Sky Charter India does not endorse, control, or assume responsibility for any third-party content, products, or services. Your use of third-party services is at your own risk and subject to the third party's terms and conditions.

While Sky Charter India endeavors to ensure the accuracy of information displayed on the Platform, including aircraft specifications, operator details, and pricing, it does not guarantee the completeness, accuracy, or timeliness of such information. Customers should verify all details directly with the operator before confirming any booking.

By using the Platform and making a booking, the Customer acknowledges and agrees that:

• Flight execution depends on operator approval and operational feasibility
• Flights may be affected by weather, technical issues, airport restrictions, or government approvals
• Sky Charter India cannot guarantee operator performance, aircraft availability, or flight completion
• Sky Charter India does not guarantee the quality, safety, or suitability of any operator's services
• The Customer assumes all risks associated with aviation charter services
