1. Overview
Sky Charter India acts solely as an aviation marketplace and booking facilitator. Payment terms are determined by individual operators and may vary based on the type of service, aircraft, route, and booking conditions.
All prices displayed on the Platform are indicative and subject to operator confirmation. Final pricing shall be communicated to the Customer at the time of booking confirmation.
2. Direct Payment to Operator
Where a customer pays directly to an operator:
- The payment constitutes a direct commercial transaction between the customer and the operator
- Sky Charter India is not a party to such transaction
- Sky Charter India does not hold, process, or transfer customer funds
- Sky Charter India has no liability for refunds, compensation, or chargebacks
- The operator is solely responsible for invoicing, tax compliance, and payment collection
- Any payment disputes must be resolved directly between the customer and the operator
3. Payment Through Sky Charter India
Where payment is collected through Sky Charter India:
- Sky Charter India acts solely as a collection and facilitation agent
- Collection of payment does not create liability for flight execution
- Flight execution remains solely the operator's responsibility
- Sky Charter India shall remit the agreed amount to the operator as per the operator agreement
- Platform fees, if any, shall be deducted as specified in the operator agreement
4. Pricing & Quotes
All quotes provided through the Platform are based on information available at the time of quotation. Final pricing may vary based on:
- Aircraft availability and type
- Route, distance, and flight duration
- Landing fees, parking charges, and handling fees
- Crew expenses, including accommodation and per diem
- Fuel surcharges and currency fluctuations
- Government taxes, GST, and regulatory fees
- Special requests (catering, ground transportation, etc.)
5. Taxes & Duties
All applicable taxes, including Goods and Services Tax (GST), shall be borne by the customer as per Indian tax laws. Operators are responsible for issuing tax-compliant invoices. Sky Charter India does not provide tax advice and recommends customers consult a tax professional for specific tax implications.
6. Payment Security
Sky Charter India employs industry-standard security measures to protect payment information. However, Sky Charter India shall not be liable for any unauthorized access, data breaches, or fraud perpetrated by third parties. Customers are responsible for maintaining the confidentiality of their payment credentials.
7. Payment Disputes
Any payment disputes must be raised in writing within seven (7) days of the transaction date. Sky Charter India shall coordinate with the operator to resolve the dispute but assumes no financial liability for disputes arising from direct customer-operator transactions.
8. Refund Processing
Refund processing timelines depend on the operator's internal processes, banking procedures, and the payment method used. Sky Charter India shall coordinate refund requests where it has collected payment, but does not guarantee specific refund timelines. For direct operator payments, all refund requests must be directed to the operator.
